California law provides many protections for employees that blow the whistle on actual or perceived violations of the law by their employer. The California Legislature has recently enacted amendments expanding worker protections, which has resulted in a significant uptick in workers filing whistleblower retaliation lawsuits. These lawsuits can be disruptive to the workplace, may result in audits by governing agencies, and can result in significant costs and penalties associated with defending these claims. Whistleblower claims are particularly prevalent in the construction industry, due to the many building and safety regulations this industry must follow. In this seminar we will discuss:• The laws that protect whistleblowing activities in California;• Recent trends in legislation and claims;• How to handle internal and external complaints; and• Recommended policies and practices to encourage employees to report internally before going to a governmental agency. *Added Bonus – Update on Drug Testing in California in light of the legalization of recreational marijuana and new OSHA Anti-Retaliation Rules that impact post-accident drug testing.
